1. Acceptance of Terms

By accessing or using StockCount ("the Service"), operated by StockCount ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

StockCount is an inventory management application for food service businesses. The Service provides voice and text-based inventory counting, cost tracking, analytics, and integrations with third-party point-of-sale systems. Features vary by subscription tier.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date.

4. Subscriptions and Billing

Paid features require a subscription purchased through the Apple App Store. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Billing is managed by Apple. Refund requests must be directed to Apple in accordance with their policies.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials or allow others to access your account

6. Your Data

You retain ownership of all data you enter into the Service, including inventory records, recipes, expenses, and business information. We do not claim ownership of your data. You grant us a limited license to use your data solely to provide and improve the Service. See our Privacy Policy for details on how we handle your data.

7. Third-Party Integrations

The Service may integrate with third-party services such as Square POS. Your use of those integrations is subject to the respective third party's terms and conditions. We are not responsible for the availability, accuracy, or reliability of third-party services.

8. AI-Powered Features

The Service uses artificial intelligence for voice recognition, text chat, and analytics. AI-generated outputs are provided as tools to assist your decision-making and should not be treated as professional advice. You are responsible for reviewing and verifying any data or suggestions produced by the AI before acting on them.

9. Limitation of Liability

To the maximum extent permitted by law, StockCount shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may cancel your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period following account termination.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms within the app or on our website. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
